Clearance of goods under various customs regimes

In general, the customs regime is one of the key institutions of customs affairs. It consists of a number of provisions that allow determining and assessing the status of goods moving across the border. In this case, customs documentation provided to the authorized body is used to carry out customs control.

There are several main types of customs regimes. These include import and export, transit, customs warehouse, refusal in favor of the state, etc. Each of them has its own key characteristics and features that will help you prepare for customs processes faster and better.

What you need to know about import in Ukraine?

Import is a separate regime that allows you to import goods into the customs territory of the country without time restrictions.

What is necessary for competent and legal import of products:

  • Presence of documentation confirming the quality and safety of the goods, i.e. compliance with the customs requirements of the country.
  • Payment of taxes and duties stipulated by the current legislation of the country.
  • Compliance with requirements relating to non-tariff regulation and other auxiliary criteria.

Please note that in addition to import, there is such a customs regime as reimport. It comes into force if goods from Ukraine were exported abroad and are now imported back within a certain period. There are also a number of rules for this regime, in particular, documentation must be provided for all products confirming domestic production and that these goods were not used to generate any income abroad.

The consequences of insignificant compliance with such standards and requirements are regulated by the Customs Code. Amendments to the current legislation are introduced through the work of the Cabinet of Ministers of Ukraine.

Let's talk about the export regime in Ukraine

Export is a regime that regulates the export of domestically produced products without the obligation to return them to the territory of the state. To fulfill all the conditions of this regime, do not forget about the following simple rules:

  • All units of goods must be provided with permits confirming that the products are safe, meet the quality indicators of the importing country, are not historical or cultural value, etc.
  • In addition, you must pay all taxes and fees, and in full, the amount of which is regulated by current legislative acts.

Speaking of re-export, that is, products that were imported into Ukraine from abroad and are now being exported back, it is also worth remembering that this can only be done with a special permit issued by the authorized body of the Cabinet of Ministers. Provided that the products are fully preserved in their original form, the required storage and transportation parameters are observed, and without using these goods for profit.

And how is transit carried out?

Another of the most common customs regimes can be safely considered transit. Its peculiarity is that it allows the movement of products between two customs authorities of the same state or within the same customs zone.

In order to carry out transit, it is necessary to control that the goods exactly meet the following characteristics:

  • Are in an unchanged condition specified in the documentation. The exception is natural wear and tear of the products.
  • Have not been used on the territory of Ukraine in other operations and transactions.
  • Suitable for transportation under the specified conditions, do not require prior preparation.

In this case, permits issued by authorized bodies after inspection will also be required. And the route for movement, as a rule, has clearly defined boundaries, which are observed in view of economy and maximum safety.
